Terms of Service

These Terms of Service ("Terms") govern your use of the Status Trace service ("Service") provided by ItsMonkie Limited ("we", "us", "our"). By creating an account or using the Service you agree to these Terms.

Status Trace is a hosted status page product that lets you publish the current operational state of your services to your customers, and notify subscribers when incidents occur.

You must provide an accurate email address. You are responsible for activity that happens under your account. You may terminate your account at any time from the account page; we will delete associated data subject to the Privacy Policy.

You agree not to use the Service to publish unlawful content, to harass anyone, to attempt to gain unauthorised access to other accounts or to our infrastructure, or to send spam through our subscriber notification system.

The Service is currently available at no charge. We reserve the right to introduce paid plans, and to modify the limits of the free tier in future. We will notify affected users by email at least 30 days before any change to the free tier limits or to the price of any plan to which they are subscribed.

Pricing and feature changes will be communicated to affected users by email and posted on our marketing site.

Subscribers to your status page provide their email addresses to you, not to us. You are the data controller for that information and you must have a lawful basis for sending notifications to them. We act as a data processor on your behalf.

We aim to keep the Service available but we do not guarantee any specific uptime. The Service is provided "as is", without warranties of any kind, to the maximum extent permitted by applicable law.

To the maximum extent permitted by law, our aggregate liability arising out of or in connection with the Service is limited to the amount you have paid to us in the twelve months preceding the event giving rise to the claim, or £100 if you have paid us nothing.

We may update these Terms. The "Last updated" date at the top of this page will change. Material changes will be notified by email. Continued use of the Service after a change constitutes acceptance of the new Terms.

These Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising from these Terms or your use of the Service.
